Evaluation terms

The short version. You can use this evaluation copy free, until the date on your welcome screen, to decide whether Ethpaga could work for you or your organisation. Keep it confidential, don’t pass on your link, never use it on employees, candidates or anyone else, and don’t rely on its results.

Who these terms are between

ETHPAGA PTY LTD (ACN 702 760 861, ABN 50 702 760 861, Suite 17, 89–97 Jones St, Ultimo NSW 2007), called “Ethpaga” or “we” here, and the person named on the evaluation link (“you”). If you are evaluating Ethpaga for an organisation, you also accept these terms for that organisation and confirm you are authorised to do so.

You accept these terms by tapping “I agree — show me”. No signature is needed. Each time you agree, we record it.

What you get

Free, temporary access to an evaluation copy of Ethpaga Job Check, so that you can consider a possible licence, partnership, purchase or other business arrangement with Ethpaga. Nothing in these terms obliges either of us to enter into any such arrangement, and nothing here is an offer of one.

Your access is personal to you. It runs until the date shown on your welcome screen. We may extend it, change it or end it at any time, without notice.

What you may do

Use the evaluation copy yourself, as often as you like while your access lasts.
Show it to colleagues, or to an audience, while you are operating it (for example in a meeting or a presentation).
Tell us what you think of it.

What you must not do

Use it on other people. Never use it, or anything it produces, to recruit, screen, select, assess, rank, hire, promote, manage, discipline or make any decision about any employee, candidate or other person.
Pass on your link or code. Anyone who wants to use it themselves needs their own access, which they can request at now.ethpaga.com/request.
Copy it. Do not copy, scrape, reverse-engineer or extract its rules, lists, categories, tables, wording or design, and do not use it to build, train or improve anything similar.
Publish results about employers. Do not publish or share any result in a way that names an employer or presents a result as a statement about a particular organisation.
Use it for anything unlawful, or in a way that could damage Ethpaga or anyone else.

Confidentiality

The evaluation copy, how it works, and anything we tell you about Ethpaga that is not public are confidential. Keep them confidential, use them only to evaluate Ethpaga, and share them only with colleagues who need to know for that purpose and who are bound to keep them confidential.

This does not cover information that is already public (other than through a breach of these terms), that you already knew or develop independently, or that the law requires you to disclose. It continues after your access ends.

About the results

Results are estimates from a rule-based model about kinds of workplace. They are not a statement of fact about any organisation, not a prediction for any person, and not professional, career, legal, financial or psychological advice. We do not promise that any result is accurate. Do not rely on a result for any decision.

Ownership and feedback

Ethpaga Job Check, the Ethpaga model, its categories, rules, lists and text, and all intellectual property in them belong to Ethpaga Pty Ltd. These terms give you only the limited right to evaluate it described above.

If you give us feedback or suggestions, we may use them freely, without any obligation to you.

No warranty and limitation of liability

The evaluation copy is provided free and “as is”, for evaluation only. To the fullest extent the law allows, we exclude all warranties, guarantees, conditions and representations, and we are not liable to you or your organisation for any loss or damage of any kind (including indirect or consequential loss, and loss of profit, data, opportunity or reputation) arising from the evaluation copy, its results or these terms, however caused, including by negligence.

Where a law gives you a right or remedy that cannot be excluded, these terms do not exclude it. Where our liability under such a law can be limited, it is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

You are responsible for any use of the evaluation copy that breaches these terms, and for any claim made against Ethpaga by anyone else because of it.

Privacy

What we record about you: the name and email address we use to give you access; the end date of your access; and, every time you tap “I agree”, your code, your name, the time, the version of these terms, and whether you were on a phone or a computer and its screen width.

If you request access, we receive the details you enter on the request form.

Why: to give, manage and end access, to keep a record of these terms being accepted, and to contact you about Ethpaga. We do not sell or share these details, and we do not use them for anything else.

Where it is kept: with our web host, Netlify (in the United States), and in our email. Requests that are not approved are deleted after 12 months. Other records are kept while we have dealings with you and for as long as we need them as a record of these terms being accepted.

What you enter in a check works as it does on the public app: what you write about how you work stays on your device; to work out a result, only your three choices (a working-style description, a kind of workplace and how far in you are) go to our server, and are not kept. A typed employer name that is not on the built-in list is looked up on Wikidata through our server, so Wikidata does not receive your IP address. Our web host keeps standard server logs, including IP addresses.

Ending

Either of us can end your access at any time. When it ends, stop using the evaluation copy. The sections on what you must not do, confidentiality, ownership, liability and governing law continue to apply.

Changes

If we change these terms, the new version applies from the next time you agree to it on your welcome screen. Each version has its own number at the top of this page.

Governing law

These terms are governed by the law of New South Wales, Australia. Both of us submit to the exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them. These terms are the whole agreement between us about the evaluation copy.
